1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and Road Apples Removal Ltd. ("Company," "we," "us," or "our"), an Ontario corporation, governing your use of our roll-off bin rental and waste removal services.
By requesting a quote, booking a service, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not use our services.
If you are entering into these Terms on behalf of a business or other legal entity, you represent that you have the authority to bind such entity to these Terms.
2. Description of Services
Road Apples Removal provides the following services in Southwestern Ontario:
- Roll-Off Bin Rental: Delivery, rental, and pickup of roll-off bins/dumpsters for waste disposal
- Construction Debris Removal: Disposal of construction and demolition waste
- Renovation Waste Removal: Disposal of renovation and remodeling materials
- Home Clean-Out Services: Bin rental for residential cleanouts, estate cleanouts, and decluttering
- Equine Waste Management: Collection and disposal of horse manure and stable bedding
Service availability, bin sizes, and specific offerings may vary. We reserve the right to modify, suspend, or discontinue any service at any time without prior notice.
3. Service Area
Our services are available in Southwestern Ontario, including but not limited to the following counties:
- Middlesex County (including London, Strathroy, Lucan)
- Huron County (including Goderich, Clinton, Exeter)
- Perth County (including Stratford, St. Marys, Listowel)
- Lambton County (including Sarnia, Petrolia, Forest)
- Oxford County (including Woodstock, Tillsonburg, Ingersoll)
Service to locations outside our standard service area may be available upon request and may be subject to additional fees. Please contact us to confirm service availability for your location.
4. Pricing and Payment
4.1 Pricing
Pricing for our services is based on various factors including bin size, rental duration, waste type, weight, and delivery location. All prices quoted are in Canadian dollars (CAD) and are subject to applicable taxes (HST).
Quotes provided are estimates based on information provided by the Customer. Final charges may vary based on actual waste weight, rental duration, and any additional services required. We reserve the right to adjust pricing due to changes in disposal fees, fuel costs, or other operational expenses.
4.2 Additional Charges
Additional charges may apply for:
- Exceeding the weight limit for the bin size rented
- Extended rental periods beyond the agreed term
- Disposal of prohibited or hazardous materials
- Dry runs (delivery attempts when the site is inaccessible)
- Relocation of bins after initial placement
- Damage to bins or equipment
- Same-day or rush service requests
4.3 Payment Terms
Payment terms will be communicated at the time of booking. We may require payment in advance, upon delivery, or upon pickup, depending on the service and Customer relationship. Accepted payment methods will be communicated at the time of service.
Overdue accounts may be subject to interest charges at a rate of 2% per month (24% per annum) on outstanding balances. We reserve the right to suspend services and pursue collection activities for unpaid accounts.
5. Booking, Scheduling, and Cancellation
5.1 Booking
Bookings can be made by phone, email, or through our website contact form. A booking is confirmed only upon our written or verbal confirmation. We will make reasonable efforts to accommodate your preferred dates but cannot guarantee specific delivery or pickup times.
5.2 Scheduling
Delivery and pickup times are estimates and may be affected by weather, traffic, equipment availability, and other factors beyond our control. We will make reasonable efforts to notify you of any significant delays.
5.3 Cancellation
Cancellations must be made at least 24 hours before the scheduled delivery time. Cancellations made with less than 24 hours' notice may be subject to a cancellation fee. Cancellations after the bin has been dispatched for delivery may be subject to the full delivery charge.
5.4 Rental Period
The rental period begins on the date of delivery and ends on the date of pickup. Extensions to the rental period must be requested and confirmed by us. Additional rental fees will apply for extended periods.
6. Customer Responsibilities
As a Customer, you agree to:
- Provide accurate and complete information when requesting services
- Ensure the delivery location is accessible for our trucks and equipment
- Obtain any necessary permits for bin placement on public property (street, sidewalk, etc.)
- Ensure you have the legal right to place a bin at the specified location
- Not move or relocate the bin once it has been placed
- Not overload the bin beyond its capacity or weight limit
- Not place prohibited materials in the bin (see Section 7)
- Keep the area around the bin clear and accessible for pickup
- Notify us promptly when the bin is ready for pickup
- Be present or have an authorized representative present during delivery and pickup if required
- Comply with all applicable municipal bylaws and regulations
7. Prohibited Materials
The following materials are strictly prohibited and may NOT be placed in our bins:
- Hazardous Waste: Chemicals, solvents, pesticides, herbicides, acids, bases, reactive materials
- Flammable Materials: Gasoline, propane tanks, oil, fuels, flammable liquids
- Toxic Materials: Asbestos, lead paint, contaminated soil
- Medical Waste: Needles, syringes, pharmaceutical waste, biomedical waste
- Electronic Waste: Computers, televisions, monitors (unless specifically arranged)
- Appliances with Refrigerants: Refrigerators, freezers, air conditioners (unless properly decommissioned)
- Batteries: All types including automotive, lithium, and household batteries
- Tires: Unless specifically arranged and quoted
- Wet Paint: Liquid paint, paint thinners
- Food Waste: Organic food waste, perishables
- Animal Carcasses: Dead animals (except for equine waste service)
- Radioactive Materials: Any radioactive substances
If prohibited materials are found in the bin, we reserve the right to:
- Refuse to collect the bin until prohibited materials are removed
- Remove the prohibited materials at your expense
- Charge additional fees for special handling and disposal
- Report violations to appropriate authorities
- Hold you liable for any fines, penalties, or costs incurred
8. Bin Placement and Access
8.1 Placement Location
You must provide a suitable location for bin placement that is:
- On a firm, level surface capable of supporting the weight of the bin and its contents
- Accessible by our delivery trucks (requires adequate clearance and turning radius)
- Clear of overhead obstructions (power lines, tree branches, structures)
- Not blocking traffic, sidewalks, fire hydrants, or emergency access
Our drivers will determine the final placement location based on safety and accessibility. We are not responsible for damage to driveways, lawns, or other surfaces caused by the weight of the bin or delivery equipment.
8.2 Permits
If the bin will be placed on public property (street, sidewalk, boulevard), you are responsible for obtaining any required permits from the municipality. We can provide information about permit requirements but obtaining permits is your responsibility.
8.3 Access for Pickup
You must ensure the bin remains accessible for pickup. If our truck cannot access the bin due to obstructions, vehicles, or other barriers, a dry run fee may apply, and pickup will be rescheduled.
9. Damage, Loss, and Liability
9.1 Damage to Bins
You are responsible for the bin while it is on your property. You will be liable for any damage to the bin beyond normal wear and tear, including but not limited to:
- Damage caused by overloading
- Fire or heat damage
- Vandalism occurring on your property
- Damage from prohibited materials
- Damage from moving or relocating the bin
9.2 Property Damage
We take reasonable precautions during delivery and pickup. However, we are not liable for:
- Damage to driveways, lawns, or landscaping from normal bin placement
- Pre-existing cracks or damage to surfaces
- Damage caused by unstable or unsuitable placement surfaces
- Underground utilities, pipes, or structures that were not disclosed
Please inform us of any underground utilities or sensitive areas before delivery.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- Our total liability for any claims arising from or related to our services shall not exceed the amount paid by you for the specific service giving rise to the claim.
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, business opportunities, or data.
- We shall not be liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including but not limited to weather, natural disasters, labour disputes, government actions, or equipment failures.
Some jurisdictions do not allow certain limitations of liability. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
11. Indemnification
You agree to indemnify, defend, and hold harmless Road Apples Removal Ltd., its officers, directors, employees, agents, and contractors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your breach of these Terms; (b) your violation of any law or regulation; (c) your negligence or wilful misconduct; (d) the disposal of prohibited materials; (e) any claims by third parties related to your use of our services; or (f) any inaccurate information you provide to us.
12. Intellectual Property
All content on our website, including but not limited to text, graphics, logos, images, and software, is the property of Road Apples Removal Ltd. or its licensors and is protected by Canadian and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.
13. Privacy
Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the practices described in our Privacy Policy.
14. Termination
We reserve the right to refuse service, terminate accounts, or cancel bookings at our sole discretion, including but not limited to situations where:
- You breach any provision of these Terms
- You fail to make payment when due
- You provide false or misleading information
- Continuing to provide service would be unsafe or impractical
- You engage in abusive or threatening behaviour toward our staff
Upon termination, you remain liable for all fees and charges incurred up to the date of termination.
15. Dispute Resolution
In the event of any dispute arising out of or relating to these Terms or our services, the parties agree to first attempt to resolve the dispute through good faith negotiations. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue other remedies available at law.
Any legal action or proceeding shall be brought exclusively in the courts of the Province of Ontario, and you consent to the jurisdiction of such courts.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.
17. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. The "Last Updated" date at the top of these Terms indicates when they were last revised. Your continued use of our services after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
18. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining provisions, which shall continue in full force and effect.
19. Entire Agreement
These Terms, together with our Privacy Policy and any service-specific agreements or quotes provided to you, constitute the entire agreement between you and Road Apples Removal Ltd. regarding the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
